In NSW there are many smoke and vapour-free public spaces. They protect the community from exposure to harmful second-hand smoke.

NSW Health facilities 

All NSW Health facilities are smoke and vapour-free. This applies to patients, visitors, and staff.

If you are admitted to hospital, support can be provided to help you manage your nicotine dependence (withdrawals and cravings), including the provision of Nicotine Replacement Therapy (NRT). Speak to a nurse or doctor for more information.

Indoor and outdoor spaces

In NSW there are many smoke and vapour-free public spaces. The same laws that prohibit smoking in certain places applies to vapes too. They protect the community from exposure to harmful second-hand smoke. These places include:  

  • Playgrounds
  • Dining areas – indoor and outdoor
  • Entries and exits to public buildings
  • Public transport (including platforms and bus stops)
  • Sporting events

Our Public Health Unit responds to complaints about smoking or vaping in a smoke-free area. Penalties exist for non-compliance. Business and building occupiers are encouraged to read and comply with the requirements.

Sale of tobacco and e-cigarettes (vapes) in NSW

In NSW, there are strict laws that govern the sale of tobacco and tobacco products including e-cigarettes. 

NSW Health’s Environmental Health branch is responsible for ensuring retailers follow these laws.

You can report retailers you think are breaking these laws, by calling the Tobacco Information Line on 1800 357 412 or reporting them online to NSW Health.
